Services

Specific engagements may be governed by additional terms or a separate Statement of Work agreed in writing before the project begins.
Payment
All fees for our services must be paid partially or in full before the start of a project, in line with the schedule set out in your proposal or SOW. We accept payment by bank transfer and, where mutually agreed, cash. If a client fails to make a payment when due, we reserve the right to suspend or terminate the project and retain any deposit or advance payment as compensation for work already performed.
Client responsibilities
You agree to provide accurate information, timely feedback, and any materials required for us to deliver the services. Delays caused by missing approvals, assets, or access may extend timelines and could affect agreed deliverables.
Changes to the website & services
We reserve the right to make changes to our website and services at any time without notice. We make reasonable efforts to keep them operational, but cannot guarantee uninterrupted availability. We may add, change, or remove features at any time.
Intellectual property
All copy, design, code, and other content on this website is owned by Robert Băjenaru Agency or used with permission. You may not reuse our content without our express written consent. Any deliverables created for a client become the property of the client upon full payment, and we will provide the relevant final files and assets.
Third-party tools & subprocessors
We may use third-party platforms, integrations, and service providers (for example: hosting, analytics, email delivery, advertising platforms) to deliver our services. Use of those platforms is subject to their own terms and privacy notices.
Confidentiality
Each party agrees to keep confidential any non-public information shared during an engagement. We will not disclose your business information to third parties except as needed to deliver the services or where required by law.
Warranty disclaimer
Our website and services are provided "as is" and "as available" without warranty of any kind, express or implied. We do not guarantee specific marketing results, that services will meet every requirement, or that they will be uninterrupted or error-free.
Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, special, incidental, consequential, or punitive damages arising out of or in connection with the use or inability to use our website or services. Our total liability for any direct damages is limited to the amount paid by you to us in the three months preceding the event giving rise to the claim.

Termination
Either party may terminate an engagement in line with the cancellation terms in the relevant proposal or SOW. We may suspend or terminate access to our website for any user who breaches these terms.
Consumer rights (EU/Romania)
If you contract with us as a consumer based in the EU, nothing in these terms limits your statutory rights, including any applicable rights of withdrawal under Romanian and EU consumer-protection law. Please contact us to exercise those rights.
Governing law
These terms and conditions are governed by the laws of Romania, without regard to its conflict-of-laws principles. Disputes will be subject to the exclusive jurisdiction of the competent courts in Bucharest, Romania, unless mandatory consumer law requires otherwise.

We may update these terms from time to time. The "last updated" date at the top reflects the latest revision. Continued use of the website after changes are posted constitutes acceptance of the revised terms.
